1. Agreement to Terms

By using Utubora Communication Systems ("Utubora", "the Platform", "our Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These Terms apply to all users of the platform, including contractors who subscribe to our services and their end customers who interact with our AI receptionist.

2. Description of Services

Utubora provides an AI-powered answering service platform that enables home service contractors to:

• Receive and process inbound customer calls through our AI receptionist (Amy)
• Automatically book and manage service appointments
• Send SMS appointment confirmations and reminders to customers
• Collect post-job customer ratings and reviews
• Manage dispatch, calendar, and customer relationships

3. Contractor Subscriptions

Contractors who subscribe to Utubora agree to the following:

• Standard Plan — $297/month: Includes AI answering service, dispatch inbox, calendar, and analytics
• Pro Plan — $397/month: Includes all Standard features plus Review Boost, CRM, and Invoicing
• Enterprise Plan: Custom pricing — includes White Label and custom domain options

Subscriptions are billed monthly. Thirty days written notice is required for cancellation. No refunds are provided for partial months.

4. SMS Messaging Terms

By providing a phone number through our platform, customers consent to receive SMS messages related to their service request. These messages are transactional in nature and include appointment confirmations, reminders, and post-job follow-ups.

• Message frequency depends on service interactions
• Standard message and data rates may apply
• Reply STOP to opt out of all SMS messages
• Reply HELP for assistance

We do not send unsolicited marketing messages. All SMS communications are directly related to service requests initiated by the customer.

5. Acceptable Use

You agree not to use Utubora to:

• Send spam or unsolicited communications
• Violate any applicable laws or regulations
• Impersonate any person or entity
• Collect or store personal data without proper consent
• Interfere with or disrupt the platform or its servers

6. Data and Privacy

Your use of Utubora is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of information as described in our Privacy Policy.

7. Intellectual Property

All content, features, and functionality of the Utubora platform — including but not limited to software, text, graphics, and logos — are owned by Utubora Services LLC and are protected by applicable intellectual property laws.

8. Limitation of Liability

Utubora Services LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the platform. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the three months preceding the claim.

9. Service Availability

We strive to maintain 99% uptime for our platform. However, we do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice.

10. Changes to Terms

We reserve the right to update these Terms at any time. We will notify contractors of material changes via email. Continued use of the platform after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
